___________________________________________________ DISMISSED FOR LACK OF JURISDICTION: August 4, 1995 ___________________________________________________ GSBCA 13360-P HOME HEALTH CARE SERVICES, Protester, v. DEPARTMENT OF VETERANS AFFAIRS, Respondent. Leonard T. Eldridge, General Manager of Home Health Care Services, Cincinnati, OH, appearing for Protester. William E. Thomas, Jr., and Merilee Rosenberg, Office of General Counsel, Department of Veterans Affairs, Washington, DC, counsel for Respondent. Before Board Judges NEILL, VERGILIO, and DeGRAFF. DeGRAFF, Board Judge. This protest, filed on August 1, 1995, states that bidders are responding to a solicitation for oxygen services. We have the authority to consider a protest only if the procurement at issue is for computers or computer-related products and services. Because it does not appear likely that we have the authority to consider this protest, the presiding judge called the parties on August 2, 1995, in order to convene a telephone conference. The purpose of the conference was to explain the limits of our authority and to determine whether protester wished to withdraw its protest in order to pursue any other available remedies. Protester's representative did not return the Board's telephone call and so we were unable to confer with the parties. On the morning of August 3, 1995, the presiding judge ordered the protester to contact the Board and to establish by noon on August 4, 1995, that this procurement is for computers or computer-related products and services. The order stated that the protest would be dismissed for lack of jurisdiction if the protester failed to make such a showing. The protester did not respond to the order. Because the procurement at issue in this protest is for oxygen services, the protest is DISMISSED FOR LACK OF JURISDICTION. ________________________________ MARTHA H.
