___________________________________________________ AMENDED ORDER OF DISMISSAL: September 25, 1995 ___________________________________________________ GSBCA 13357-P INTERACTIVE SYSTEMS, INC., Protester, v. SMALL BUSINESS ADMINISTRATION, Respondent, and DATA MANAGEMENT ASSOCIATES, INCORPORATED, Intervenor. L. James D'Agostino, Timothy B. Harris, and Brian Waagner of Wickwire Gavin, P.C., Vienna, VA, counsel for Protester. John W. Klein, Audrey H. Liebross, and Susan Sundberg, Office of General Counsel, Small Business Administration, Washington, DC, counsel for Respondent. Cyrus E. Phillips, IV, and Christopher M. Johnson of Kilcullen, Wilson and Kilcullen, Washington, DC, counsel for Intervenor. NEILL, Board Judge. AMENDED ORDER OF DISMISSAL This protest was filed by Interactive Systems, Inc. (ISI) on July 27, 1995. ISI contends that a contract award by the Small Business Administration (SBA) to Data Management Associates, Inc. (Data Management) was contrary to statute and regulation. Data Management has intervened in this protest as an intervenor of right. By order dated August 24, 1995, we dismissed this protest without prejudice. The dismissal was to be deemed "with prejudice" in the event no party moved to reinstate this protest within thirty days from the date of the order. On Friday, September 22, counsel for protester formally suggested that the aforementioned thirty-day period be extended by an additional two weeks. Although SBA originally opposed this proposal, in a conference convened by the Board on Monday, September 25, it withdrew its objection. Accordingly, in the absence of objection, the Board amends its order of August 24 dismissing this protest. The thirty-day period referenced in that order is hereby extended by an additional fourteen days. ____________________ EDWIN B. NEILL Board Judge
