ISI contends that a contract award by the Small Business Administration to Data Management Associates, Inc. (Data Management) was contrary to statute and regulation. Data Management has intervened in this protest as an intervenor of right. On Thursday, August 24, after conferring with the Board, counsel for the parties advised the Board that they had reached settlement and moved that the protest be dismissed without prejudice, to be deemed dismissed with prejudice if no motion to reinstate the protest is brought within thirty days from the date of this order. The Board grants the motion. This protest is DISMISSED WITHOUT PREJUDICE. This dismissal shall be deemed to be with prejudice if no motion to reinstate the protest is brought within thirty days from the date of this order.
