At the same time this cost application was filed, applicant advised the Board that the parties were engaged in settlement discussions and expected that an agreement would be reached in the near future. The Board issued an order on June 27 encouraging the parties to continue their settlement discussions and directing respondent to file its response to the application by July 24, 1995, if a settlement had not been reached prior to that date. On July 24, applicant advised the Board that a settlement agreement had been reached and that the necessary paperwork to effectuate the settlement was being processed. Applicant stated that the Board would be notified once the settlement was consummated. On January 17, 1996, upon inquiry by the Board, counsel for respondent advised that applicant had been paid. Counsel was asked to file a motion to dismiss with the Board. On February 13, applicant filed such stating that the parties have entered a settlement agreement relating to the motion for the recovery of protest costs, and moved to dismiss the motion.
