ORDER On February 23, 1995, protester, Samtech Research, Inc., filed this protest against respondent's, the Department of the Navy, request for proposals (RFP) N00140-95-R-0926 for the procurement of computer workstations. Protester alleges in its complaint that various provisions of the solicitation are highly restrictive to the competition and further alleges that certain sections of the solicitation are in violation of the Federal Acquisition Regulation. On February 28, the Board convened the parties in a prehearing conference and established a schedule for further proceedings, which included written discovery. On March 17, after receiving respondent's replies to its discovery requests, protester filed a motion for dismissal of its protest. Protester further requested that the Board's order granting dismissal of its protest state that each side is to bear its own costs incurred in this matter. Respondent has no objection to protester's request. Accordingly, pursuant to Rule 28(a) and the motion of protester, this protest is DISMISSED.
