Applicant, Data General Corporation (Data General) seeks $58,867.87, as allowed by the Brooks Act, 41 U.S.C. 759(f)(5)(C) (1988), for the costs of filing and pursuing its protest. Data General prevailed in Data General Corp. v. Department of the Army, GSBCA 13009-P, 95-1 BCA 27,402, 1994 BPD 299. Data General incurred legal fees of $46,855. Affidavit of Richard J. Webber (Webber Affidavit) at 6 (Feb. 10, 1995). The principal partner on the case spent 143 hours on the protest, for which Data General was charged $37,895. Id. at 4. Another attorney spent 30.3 hours, for which Data General was charged $6,060. Id. at 5. A third attorney spent 20 hours, for which Data General was charged $2,900. Id. The attorneys also incurred expenses of $4,233.87 for long distance telephone, computerized legal research, messenger, and transcript expenses. Id. at 6. The attorneys hired a consultant to assist them in prosecuting the protest; the consultant testified as an expert witness. Webber Affidavit at 7. The consultant charged the attorneys $7,779, which charges have been or will be paid in full by Data General. Id. Discussion Respondent does not object to Data General's application. Prevailing parties are entitled to recover their costs of filing and pursuing the protests, including reasonable attorney fees and expenses, and in-house employee salaries and expenses. 40 U.S.C. 759(f)(5)(C) (1988); Sterling Federal Systems v. Goldin, 16 F.3d 1177 (Fed. Cir. 1994); Integrated Systems Group, Inc. v. Department of the Army, GSBCA 12622-C(12521-P, et al.), 94-2 BCA 26,819, 1994 BPD 65. We have reviewed the application and find reasonable the hourly rates and the hours spent by the attorneys and the consultant in pursuing the protest. Decision Data General's application is GRANTED. Data General is entitled to $58,867.87, which Data General necessarily and reasonably incurred in filing and pursuing the protest.
