ORDER This protest was filed on January 9, 1995, by Integrated Systems Group, Inc., against the Department of the Navy. Respondent is seeking to procure Sun Microsystems "brand name only" workstations and peripherals. Protester alleges that respondent failed to achieve full and open competition by using overly restrictive specifications in the solicitation. During a prehearing conference on January 11, 1995, respondent advised the Board that it would be filing a motion to dismiss for lack of jurisdiction on the ground that this procurement is exempt under the Warner Amendment, 10 U.S.C. 2315 (1988), from Brooks Act jurisdiction. 40 U.S.C. 759(a)(3)(C) (1988). The motion was filed at 2:07 p.m. that same day, and at 4:28 p.m., protester moved for a voluntary dismissal with prejudice of its protest. Respondent concurs with protester's motion.
