Cyberchron Corporation's protest against the Department of the Navy's award of a contract for the supply of rack-mounted ruggedized computers was resolved promptly by settlement. The agency admitted that the award was based on an erroneous price evaluation; it terminated the originally-awarded contract and made an award to Cyberchron instead. Cyberchron Corp. v. Department of the Navy, GSBCA 13042-P, 1994 BPD 263 (Nov. 14, 1994). Following dismissal of the case, Cyberchron filed an application for an award of costs incurred in filing and pursuing the protest. The amount of reimbursement requested is $6,800. The terms of the settlement agreement make plain that Cyberchron was the prevailing party in the protest: the agency admitted a pivotal violation of law and gave the protester all that it sought in bringing the case. Cyberchron has provided documentation showing that it spent $6,906.20 in attorney fees and miscellaneous litigation-related expenses in filing and pursuing the protest. The Navy has no objection to our granting the amount requested, $6,800. We find that this amount is reasonable in light of the complexity and duration of the case. Decision We consequently GRANT Cyberchron's application and award to this firm the sum of $6,800.
