DISMISSED WITHOUT PREJUDICE: December 14, 1994 GSBCA 13042-P CYBERCHRON CORPORATION, Protester, v. DEPARTMENT OF THE NAVY, Respondent. L. James D'Agostino, Timothy B. Harris, and Nikki E. Koulizakis of Wickwire Gavin, Vienna, VA, counsel for Protester. Daniel A. Laguaite, Office of Counsel, Naval Air Station, Department of the Navy, Patuxent River, MD, counsel for Respondent. DANIELS, Board Judge (Chairman). ORDER On November 14, 1994, the Board dismissed without prejudice a protest by Cyberchron Corporation against the Department of the Navy's award of a contract for the supply of rack-mounted ruggedized computers. Under the terms of our order, the dismissal was to become one with prejudice on December 15, 1994, unless either party moved for reinstatement. On December 14, the Navy asked that the order be amended to extend by thirty days the date on which the dismissal will, in the absence of a motion for reinstatement, convert to one with prejudice. Cyberchron does not object. The order of November 14 is amended so that its last sentence reads, "This dismissal shall become one with prejudice on January 17, 1995, unless either party earlier moves for reinstatement. _____________________________ STEPHEN M.
