Protester has moved that we amend our decision of December 19, 1994, in which we granted count one of this protest and dismissed without prejudice the remaining counts. Having reviewed the comments filed by respondent and intervenor regarding the motion, we grant the motion, in part, by amending the decision to read: Decision Count I of this protest is GRANTED. The remaining counts of the protest are DISMISSED without prejudice. The Department of Energy shall give EDS and all other participants in this procurement prompt written notice of any decision it makes to ratify either the procurement or the procurement and the contract award which are the subject of this protest. The dismissal ordered herein shall become a dismissal with prejudice ten working days from the date of EDS' receipt of such written notification, unless a party to this protest moves for reinstatement of the dismissed counts prior to the expiration of this ten-day period. _________________________ EDWIN B.
