DISMISSED WITH PREJUDICE: October 21, 1994 GSBCA 13011-P INTEGRATED SYSTEMS GROUP, INC., Protester, v. DEFENSE COMMISSARY AGENCY, Respondent. Shelton H. Skolnick, Bruce Trimble, Amy M. Hall, Wayne Finegar, and Amer Syed of Skolnick & Leishman, P.C., Derwood, MD, counsel for Protester. Col. William Sherman and Jay P. Manning, Defense Commissary Agency, Fort Lee, VA, counsel for Respondent. DANIELS, Board Judge (Chairman). ORDER Integrated Systems Group, Inc., protested that the Defense Commissary Agency improperly awarded a contract for the supply of computer printers. The alleged violation is that the agency evaluated proposed prices against greater quantities of printers than those for which prices were solicited; protester maintained that it was prejudiced because it was not permitted to propose prices for the numbers of printers which would satisfy the agency's true requirements. The agency provided the Board and protester with documents showing that the contract awarded is for the quantities stated in the solicitation, and that if prices had been evaluated against those quantities, the same firm would have been selected for award. Protester then promptly moved to dismiss the case with prejudice. The protest is DISMISSED WITH PREJUDICE. _________________________ STEPHEN M. DANIELS Board Judge
