ORDER On October 4, 1994, Tele-Tector of Maryland, Inc. (Tele- Tector), protested the award by the Department of Treasury's Internal Revenue Service (IRS) of a contract for an access control system for the IRS headquarters building. The protest complained that the agency's determination that the awardee's proposal represented the best value to the Government was arbitrary and capricious, in that Tele-Tector's proposal met all mandatory requirements and was priced twenty percent less than the awardee's. On the morning of October 7, the agency filed a motion to dismiss the case for lack of jurisdiction. The motion is premised on the theory that the protested procurement is not for automatic data processing equipment, and thus is not subject to the Brooks Automatic Data Processing Act, 40 U.S.C. 759 (1988), under which the Board has protest jurisdiction. The parties discussed this motion during a prehearing conference held on October 7. Later on October 7, Tele-Tector filed a motion to withdraw the protest.
