                                 ORDER
 
        On August  12, 1994, Advanced Video Products,  Inc., filed a
   request to recover its costs  of filing a pursuing the underlying
   protest,  Advanced  Video  Products  v.  Department  of  Veterans
   Affairs, GSBCA  12848-P, 1994 BPD    143 (July 14, 1994),  and of
   proposal  preparation involved  in the  procurement.   40  U.S.C.
     759(f)(5)(C)  (1988); Rule 35.   Subsequent to  an amendment to
   the application, agency objections, and discovery, on October 28,
   the agency represented to the Board that the parties have settled
   the  matter  and  request  that  the  matter  be  dismissed  with
   prejudice.  Accordingly,  this case is DISMISSED  WITH PREJUDICE.
