The Board dismissed for lack of jurisdiction the underlying protest. David I. Shapiro & Assocs. v. United States Trade & Development Agency, GSBCA 12929-P, 1994 BPD 173 (Aug. 24, 1994). On August 29, 1994, the protester, David I. Shapiro and Associates, filed a request for the Board to pursue an examination of the record developed in the case. The protester says of the Board: "As Federal Officials you are entrusted by the public to ensure that the procurement[s] made by the government are not only in accordance with the FAR [Federal Acquisition Regulation] and applicable legal statu[t]es, and are conducted in a manner that does not cast doubt on the government[']s business ethics." Statute sets forth the scope of the Board's protest jurisdiction. 40 U.S.C. 759(f) (1988). Contrary to the suggestions of the protester, having concluded that it lacks jurisdiction, the Board is not in a position to reach the merits of this protest. The protester selected the incorrect forum to pursue its protest. The protester has failed to raise a basis meriting reconsideration or further pursuit of the protest. Rules 32, 33.
