ORDER On May 31, 1994, Telegenix/GRIM Corporation filed this protest against the Department of Transportation, Federal Aviation Administration, protesting its elimination from the competitive range under a solicitation for the acquisition of Down Scoped Radio Control Equipment. Protester alleges that respondent violated statute and regulation by improperly eliminating it from the competitive range and failing to abide by the solicitation's evaluation criteria. On June 16, 1994, protester filed a motion to dismiss this protest. Respondent does not object to the motion. Accordingly, this protest is DISMISSED. Rule 28(a).
