ORDER On May 2, 1994, Integrated Systems Group, Inc. filed with the Board this protest involving the respondent, the Department of the Treasury. The protester states that it submitted a response to an agency notice of intent to place an order against a General Services Administration federal supply schedule contract. The protester asserts that, because the notice of intent did not specify a requirement for new equipment, the agency improperly restricted competition by not pursuing the used/refurbished equipment the protester identified in its response at a price below the noticed schedule price. On May 9, 1994, the protester filed a motion to dismiss with prejudice. The protester states that the agency "has agreed to evaluate the proposal [sic] submitted by" the protester.
