DISMISSED: March 10, 1994 GSBCA 12767-P PETROCREDIT CORPORATION, Protester, v. GENERAL SERVICES ADMINISTRATION, Respondent. Charlotte Rothenberg Rosen of McGuire Woods Battle & Boothe, Washington, DC, counsel for Protester. Tenley A. Carp, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. GOODMAN, Board Judge. ORDER Protester, Petrocredit Corporation, filed this protest against the General Services Administration (GSA) on February 24, 1994. Petrocredit alleges that the GSA's election to modify an existing contract with MultiService Corporation to provide for magnetic encoding of fleet fuel purchase cards and for the maintenance of a database is outside the scope of the contract. The Board convened the parties in a prehearing conference on March 2, 1994, and discussed possible problems with the Board's jurisdiction over this protest, as respondent contends that the protested procurement action does not involve automated data processing equipment (ADPE). The parties were authorized to conduct written discovery. On March 7, as a result of answers provided by GSA to Petrocredit in response to discovery requests, Petrocredit withdrew its protest to this Board. Respondent has no objection to the withdrawal. Accordingly, this protest is DISMISSED. Rule 28(a). ________________________ ALLAN H. GOODMAN Board Judge
