March 1, 1994 GSBCA 12729-C(12707-P) MATERIALS, COMMUNICATION & COMPUTERS, INC., Protester, v. DEPARTMENT OF THE NAVY, Respondent. Kenneth S. Kramer, Douglas W. Baruch, and Jay D. Majors of Fried, Frank, Harris, Shriver & Jacobson, Washington, DC, counsel for Protester. Ellen D. Washington and M. Elizabeth Hancock, Office of Counsel, Information Technology Acquisition Center, Department of the Navy, Washington, DC, counsel for Respondent. Before Board Judges DANIELS (Chairman), PARKER, and HENDLEY. DANIELS, Board Judge. Materials, Communication & Computers, Inc., moves the Board to order the Government to reimburse it for $10,000 in costs it incurred in filing and pursuing a protest against the Department of the Navy's conduct of a procurement. The protest alleged that the agency had violated regulation in eliminating protester from the competitive range. The parties settled the case after the agency admitted that the allegation was valid. Materials, Communication & Computers, Inc. v. Department of the Navy, GSBCA 12707-P (Jan. 5, 1994), 1994 BPD 1. In its motion, protester maintains that it actually incurred more than $14,952 in protest costs, but pursuant to its settlement agreement, asks the Board to award only $10,000. The Navy does not oppose the motion. We find, based on the agency's admission, that the agency violated a regulation in the conduct of the challenged procurement. 40 U.S.C. 759(5)(B) (1988). We have examined the documentation submitted by protester and find that it shows that at least $10,000 was reasonably expended to file and pursue the case. Decision Accordingly, we GRANT protester's motion. We award to protester the full amount requested, $10,000. This sum shall be paid, without interest, from the permanent indefinite judgment fund, 31 U.S.C. 1304 (1988). 40 U.S.C. 759(f)(5)(C)(i) (1988). _________________________ STEPHEN M.
