ORDER Laptops Falls Church, Inc. filed a protest of the terms of solicitation number DADA15-94-B-0001 on December 16, 1993. This solicitation is for the procurement of thirty notebook computers by the Walter Reed Army Medical Center. Initially, the solicitation, issued on November 17, 1993, called for 386/25MHz notebook computers; in an amendment issued on December 3, 1993, the Army modified one of several references to the 386/25MHz equipment to read "486/25MHZ." The amendment left all other references to the 386/25MHz equipment intact. Unable to persuade Army contracting personnel to revise the solicitation to achieve consistency, Laptops contended in its protest that the amendment to the solicitation created an inherent ambiguity in violation of statute and regulation. In a joint motion for dismissal filed on December 22, 1993, the parties indicate that they have resolved this issue, and they request that the Board dismiss this protest, without prejudice. Accordingly, this protest is DISMISSED WITHOUT PREJUDICE. Rule 28(a).
