_______________________ GRANTED: March 24, 1994 _______________________ GSBCA 12691-C(12552-P) INTEGRATED SYSTEMS GROUP, INC., Protester, v. DEPARTMENT OF AGRICULTURE, Respondent. Shelton H. Skolnick, Judy Leishman, and Amy M. Hall of Skolnick & Leishman, Derwood, MD, counsel for Protester. Jane H. Talley, Office of the General Counsel, Department of Agriculture, Washington, DC, counsel for Respondent. Before Board Judges WILLIAMS, VERGILIO, and GOODMAN. VERGILIO, Board Judge. On December 1, 1993, Integrated Systems Group, Inc., filed with the Board this motion for the award of its costs of filing and successfully pursuing the underlying protest. The protester seeks to recover a total of $15,684, which represents $15,244 in hourly attorney fees and $440 in transcript costs. The agency does not object to the award of the requested costs. The protester having prevailed in the underlying protest, and all costs being reasonable and reimbursable, the Board grants the motion. Findings of Fact By opinion dated November 3, 1993, this Board granted the underlying protest. Having determined that the agency improperly excluded the protester from the competitive range as it was finalizing the terms of the solicitation, the Board revised the agency's procurement authority to require it to place the protester in the competitive range. Integrated Systems Groups, Inc. v. Department of Agriculture, GSBCA 12552-P, 94-1 BCA 26,556, 1993 BPD 337. Documentation in the record supports the requested costs (for attorney fees and a copy of the hearing transcript) of filing and pursuing the protest. Discussion The protester seeks to recover $15,684 as its costs of filing and pursuing the underlying protest. The agency does not object to the requested award. The protester prevailed in the underlying protest. The requested costs were incurred in filing and pursuing the protest, are reasonable, and, as attorney fees and transcript costs, are of the variety found by this Board to be reimbursable. Decision The Board GRANTS the motion for recovery of $15,684 as costs of filing and pursuing the protest. The awarded amount is to be paid in accordance with statute. 40 U.S.C. 759(f)(5)(C) (1988); 31 U.S.C. 1304 (1988). ____________________________ JOSEPH A.
