ORDER On November 24, 1993, the Board docketed a protest filed by RMTC Systems, Inc. (RMTC Systems or RMTC). The protester alleged that the respondent, Department of Energy, Federal Energy Regulatory Commission, failed to make an award, under solicitation number FERC93-GIR-0419, for automatic data processing equipment to the lowest responsive bidder in violation of applicable statute and regulation. On December 3, 1993, the Board received the protester's motion to dismiss, which states: RMTC Systems would like to take this opportunity to move for dismissal of the above captioned protest, subject to the terms of a settlement agreement between RMTC and Respondent which will be submitted to you by Respondent under separate cover. RMTC will accept a dismissal with prejudice. . . . Respondent has no objection to the dismissal of this protest with prejudice. Accordingly, the protest is DISMISSED WITH PREJUDICE.
