______________________________________________ DISMISSED WITHOUT PREJUDICE: November 10, 1993 _______________________________________________ GSBCA 12666-P INTERNATIONAL DATA PRODUCTS, CORPORATION, Protester, v. DEPARTMENT OF THE NAVY, Respondent. D. Oscar Fuster, Vice President, and Maria F. Glinsmann, Contract Administrator, of International Data Products, Corporation, Gaithersburg, MD, appearing for Protester. Brian K.C. Kau, Office of Counsel, Naval Surface Warfare Center, Dahlgren Division, Department of the Navy, Dahlgren, VA, counsel for Respondent. PARKER, Board Judge. ORDER On November 4, 1993, International Data Products, Corporation filed this protest of the award of a contract for laser printers by the Department of the Navy. On November 9, the Board received a letter from the protester which stated: International Data Products, Corp. considers that it was correct to protest the award made in the above captioned solicitation, since we were the low bidder and our bid was technically responsive. However, we were informed yesterday that the Navy has accepted delivery of the procured equipment as of November 5, 1993. This being the case, this Board would, in IDP's view, be unable to provide us adequate relief if we were to succeed on the merits. Thus, we respectfully withdraw our protest and thank you for your time. This protest is DISMISSED WITHOUT PREJUDICE. Rule 28(a). The dismissal shall become one with prejudice on November 22, 1993, unless it is reinstated prior to that date. __________________________ ROBERT W. PARKER Board Judge
