______________________________________________ DISMISSED WITH PREJUDICE: November 8, 1993 _______________________________________________ GSBCA 12663-P RMTC SYSTEMS, INC., Protester, v. DEPARTMENT OF THE NAVY, Respondent. Jeff Stollman, President of RMTC Systems, Inc., Boulder, CO, appearing for Protester. Brian K. C. Kau, Office of Counsel, Naval Surface Warfare Center, Dahlgren Division, Department of the Navy, Dahlgren, VA, counsel for Respondent. PARKER, Board Judge. ORDER On November 1, 1993, the Board received this protest filed by RMTC Systems, Inc., concerning a solicitation for the procurement of automatic data processing equipment, issued by the Department of the Navy. On November 5, the Board received protestor's motion to dismiss the protest with prejudice, which provided as follows: Protester, RMTC Systems, Inc. (RMTC) moves this Board to dismiss its protest with prejudice. RMTC predicates this motion on the following: 1. Respondent has provided RMTC with a bid abstract for the subject IFB. 2. In the bid abstract there is a bidder with a lower price than RMTC which offered the same printer as RMTC. 3. Because of the above, RMTC is not in line for award of the subject solicitation - even if it should prevail in the instant protest. RMTC, therefore, does not qualify as in [sic] interested party with standing to bring the subject protest. This protest is DISMISSED WITH PREJUDICE. Rule 28(a). __________________________ ROBERT W.
