ORDER On October 28, 1993, Computer Management Corporation (CMC) filed this protest against the award of a contract to Metropolitan Technical Services, Inc. (MTS), an intervenor of right, by the Defense Information Systems Agency. CMC alleges that MTS submitted a noncompliant proposal, and that respondent's decision to award to MTS was arbitrary and without any rational basis. On November 18, 1993, the Board stayed proceedings in order for the parties to attempt to resolve their dispute. On November 24, 1993, protester filed a motion to dismiss with prejudice which states that the settlement reached between the parties "is full and complete satisfaction and settlement of all Protester's rights and Respondent's obligations under this protest." Accordingly, protester's motion is GRANTED. This protest is DISMISSED WITH PREJUDICE. Rule 28(a).
