ORDER On October 21, 1993, the Board docketed a protest filed by Laptops Falls Church, Inc. (Laptops). Laptops alleged that the respondent, Fish & Wildlife Service, U.S. Department of the Interior, Hadley, Massachusetts, failed to award the contract under solicitation number IFB FWS5-93-051 "to the lowest responsive, responsible bidder," in violation of applicable statute and regulation. On November 18, 1993, we received a signed joint motion to dismiss without prejudice from the parties. It states: COMES NOW, Respondent, Fish & Wildlife Service, U.S. Department of the Interior and Protester, Laptops Falls Church, Inc., (d/b/a Laptops, etc.), hereby jointly move to have the above captioned protest dismissed without prejudice. Such dismissal shall convert to one with prejudice ten days from the date of granting of this motion unless either party notifies the Board in writing. In accordance with the agreement of the parties, the protest is hereby DISMISSED WITHOUT PREJUDICE. Rule 28(a). On November 29, 1993, this dismissal shall become one with prejudice unless either party has requested reinstatement by the Board on or before that date.
