DISMISSED WITH PREJUDICE: October 26, 1993 GSBCA 12645-P MCA RESEARCH CORPORATION, Protester, v. DEPARTMENT OF AGRICULTURE, Respondent. R. Wood Miles, vice president and chief financial officer of MCA Research Corporation, Arlington, VA, appearing for Protester. Kenneth E. Cohen and Alan D. Groesbeck, Office of the General Counsel, Department of Agriculture, Washington, DC, counsel for Respondent. DANIELS, Board Judge (Chairman). ORDER On October 15, 1993, MCA Research Corporation filed a protest against the Department of Agriculture's award of a contract which appears to be for temporary secretarial services. The Board and agency counsel both questioned whether the services are automatic data processing equipment, as that term is defined in statute, 40 U.S.C. 759(a)(2) (1988). If the services do not fall within the definition, we do not have jurisdiction to hear the protest. Id. 759(f)(1). MCA decided that rather than seek a ruling on our authority to consider the case, it would withdraw this protest and file an identical one with the General Accounting Office. A letter to this effect was submitted on October 26. As requested by protester, we DISMISS this protest WITH PREJUDICE. _________________________ STEPHEN M. DANIELS Board Judge
