Under a sealed bid procurement, the respondent, the Department of the Air Force, had awarded a contract to Dataexpert Corp., an intervenor of right. The protester maintains that the awardee's bid is non-responsive, and that the protester is the lowest-priced, responsive, responsible bidder. On November 23, the parties filed a joint stipulation requesting that the protest be dismissed without prejudice, with the dismissal to become one with prejudice after thirty days from that date have elapsed, unless the protest is reinstated earlier. Based on the request, this protest is DISMISSED WITHOUT PREJUDICE. Rule 28(a). The Board need not now resolve the other motions of the parties, e.g., challenging the status of the protester as an "interested party" and seeking summary relief.
