The Board has received a protest from Analytical Management, Inc., stating that it wishes to protest a contract award made by Hercules Incorporated, Hercules Aerospace Company, for an asbestos survey contract at the Allegany Ballistics Laboratory, a facility of the Department of the Navy. Because the matter appears to involve an award by other than a Government agency and pertains to asbestos surveying rather than to automatic data processing equipment or services, on August 24, 1993, the Board issued an order to show cause why this protest should not be dismissed for lack of jurisdiction. Protester failed to respond to the order. The Board's protest jurisdiction is limited by statute to procurements involving the acquisition of automatic data processing equipment and services (ADPE). 40 U.S.C. 759(a), (f) (1988). ADPE is defined to include equipment "used in the automatic acquisition, storage, manipulation, management, movement, control, display, switching interchange, transmission, or reception of data or information." 40 U.S.C. 759(a)(2)(A). Moreover, the Board has no jurisdiction to entertain protests of subcontracts awarded by managing and operating prime contractors. U.S. West Communications v. U.S., 940 F.2d 622 (Fed. Cir. 1991). Decision Protester was instructed to show cause why this matter should not be dismissed for lack of jurisdiction on or before August 30, 1993.
