_________________________________________________________ DISMISSED WITHOUT PREJUDICE: August 6, 1993 _________________________________________________________ GSBCA 12514-P CBIS FEDERAL INC., Protester, v. GENERAL SERVICES ADMINISTRATION, Respondent, Joseph J. Petrillo and Jessica C. Abrahams of Petrillo & Hordell, Washington, DC; and Susan Warshaw Ebner, Senior Counsel, CBIS Federal Inc., Fairfax, VA, counsel for Intervenor CBIS Federal Inc. Seth Binstock, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent. PARKER, Board Judge. ORDER On July 30, 1993, CBIS Federal Inc. filed this protest with the Board, alleging that the General Services Administration failed to adhere to statute and regulation in evaluating proposals for a solicitation for the procurement of automatic data processing equipment. On August 5, the Board received a notice of withdrawal from counsel for protester that provided as follows: CBIS Federal Inc. ("CBIS Federal") hereby withdraws that portion of its Amended Notice of Intervention of Right and Protest Complaint (filed with the Board on July 30, 1993 and docketed as GSBCA No. 12514-P), which constitutes a protest, and requests that the Board dismiss the protest without prejudice. This dismissal without prejudice reflects the understanding of the parties to the above-captioned protest, and Judge Parker, as discussed during a conference call held on Monday, August 2, 1993, that by withdrawing the protest and requesting its dismissal without prejudice, CBIS Federal preserves all issues raised therein. Should CBIS Federal decide to raise these issues in the future, they will be timely raised, if timely as of June 30. To the extent that its Amended Notice of Intervention of Right and Protest Complaint in GSBCA No. 12514-P expands on the original Notice of Intervention, the document is not withdrawn. In accordance with the terms of the protester's request, this protest is DISMISSED WITHOUT PREJUDICE. Rule 28(a). ________________________________ ROBERT W. PARKER Board Judge
