DISMISSED WITH PREJUDICE: July 13, 1993 GSBCA 12485-P CBIS FEDERAL INC., Protester, v. DEPARTMENT OF THE INTERIOR, Respondent, and COMPUTER BASED SYSTEMS, INCORPORATED, Intervenor. Rand L. Allen, Stanley R. Soya, and Phillip H. Harrington of Wiley, Rein & Fielding, Washington, DC, and Susan Warshaw Ebner of Cincinnati Bell Information Systems Inc., Fairfax, VA, counsel for Protester. Alton Woods and James L. Weiner, Division of General Law, Office of the Solicitor, Department of the Interior, Washington, DC, counsel for Respondent. J. Patrick McMahon, Vienna, VA, and John R. Tolle of Barton, Mountain & Tolle, McLean, VA, counsel for Intervenor. DANIELS, Board Judge (Chairman). ORDER On July 6, 1993, CBIS Federal Inc. protested that the Department of the Interior's award to Computer Based Systems, Incorporated, of a contract for automatic data processing services was in violation of law. The protest alleges that the agency's technical, cost, and best value analyses of the two offerors' proposals were all in error. At the initial conference convened by the Board to discuss this case, counsel for all parties suggested that they jointly review the agency's file regarding the subject procurement before scheduling further proceedings. The agency made those documents available promptly, on the morning of July 12. On the afternoon of July 12, following counsel's review of relevant documents, CBIS Federal Inc. filed an unopposed motion to dismiss the case with prejudice. The Board now so DISMISSES the protest. Our order of July 8 suspending the agency's authority to acquire services under the contract while the protest is pending lapses with the issuance of this order. 40 U.S.C. 759(f)(3) (1988). _________________________ STEPHEN M.
