_________________________________________________ DISMISSED WITHOUT PREJUDICE: July 1, 1993 _________________________________________________ GSBCA 12453-P U.S. INTEGRATION, INC., Protester, v. DEFENSE NUCLEAR AGENCY, Respondent. George A. Alschuler, U.S. Integration, Inc., Hayward, CA, counsel for Protester. David C. Rickard, Office of General Counsel, Defense Nuclear Agency, Alexandria, VA, counsel for Respondent. HENDLEY, Board Judge. ORDER On June 8, 1993, the Board docketed a protest filed by U.S. Integration, Inc. (U.S. Integration). In its protest complaint, U.S. Integration alleged that the respondent, the Defense Nuclear Agency, proposed to award a contract under solicitation number DNA001-93-R-0035 for the acquisition of personal computers to another offeror. The protester contended that the solicitation was restrictive of competition and that the respondent's needs were unclear. On June 11--in accordance with views expressed during the Board's telephone conference with the parties on June 10--the Board received the protester's withdrawal of its protest, "leaving in place the Protest to the Defense Nuclear Agency, without prejudice to the right of United States Integration, Inc. to timely re-file the GSBCA Protest." Accordingly, the protest is DISMISSED WITHOUT PREJUDICE. Rule 28(a). The dismissal will be deemed to be with prejudice unless the protester moves to reinstate the protest prior to July 16, 1993. ____________________________ JAMES W. HENDLEY Board Judge
