(ISG) on June 1, 1993. ISG protested the rejection of its proposal by the Department of the Army (Army) as being non- responsive. ISG alleges that the Army is in violation of applicable statute and regulation. On June 9, 1993, the Board received a Motion to Dismiss filed by protester. Protester has requested the Board to dismiss the protest without prejudice, so that the matter can be considered as an agency level protest at the Headquarters of the U.S. Army Materiel Command. The Army has orally informed the Board that it has no objection to protester's motion. Accordingly, protester's motion is granted. This protest is DISMISSED WITHOUT PREJUDICE.
