_________________________________________________ DISMISSED WITH PREJUDICE: APRIL 21, 1993 _________________________________________________ GSBCA 12340-P INTEGRATED SYSTEMS GROUP, INC., Protester, v. DEPARTMENT OF THE ARMY, Respondent. Shelton H. Skolnick of Skolnick & Leishman, Derwood, MD, and S. Sam Bedi, Potomac, MD, counsel for Protester. Colonel Riggs L. Wilks, Jr., Major Charles R. Marvin, Jr., Major Karl M. Ellcessor, III, and Major Donald L. Powers, Office of the Judge Advocate General, Department of the Army, Arlington, VA, counsel for Respondent. VERGILIO, Board Judge. ORDER On March 22, 1993, Integrated Systems Group, Inc. (ISG) filed this protest concerning the respondent, the Department of the Army. This protest arose after an agency protest, in which the protester contended that the agency had improperly requested "best and final offers" (although under a request for quotations) after initially contracting with the protester. Protester raised that same issue here, as the contractor after "best and final offers," but at a price lower than its original contract price. On April 20, 1993, protester filed a motion to withdraw the protest requesting the Board to dismiss the protest with prejudice. The agency concurs with the requested dismissal. Accordingly, the protest is DISMISSED WITH PREJUDICE. Rule 28(a). ___________________________ JOSEPH A. VERGILIO Board Judge
