______________________________________________ DISMISSED WITH PREJUDICE: April 6, 1993 _____________________________________________ GSBCA 12337-P COASTAL COMPUTER CONSULTANTS CORP., Protester, v. DEPARTMENT OF THE TREASURY, Respondent. Ned W. Livornese, Colorado Springs, CO, counsel for Protester. Frederick G. Petrick, Jr. and Patricia Grady, Litigation Division, Office of the Comptroller of the Currency, Department of the Treasury, Washington, DC, counsel for Respondent. LaBELLA, Board Judge. ORDER This protest was filed by Coastal Computer Consultants Corp. (Coastal) on March 18, 1993, against the Department of the Treasury. Coastal filed its protest alleging that the Comptroller of the Currency, Department of the Treasury, failed properly to synopsize its requirements in the Commerce Business Daily and made an award to a higher priced schedule contractor without issuing a competitive solicitation as required by the Federal Information Resources Management Regulations. Coastal also complained that the agency improperly imposed unnecessary and unwarranted conditions upon Coastal without any intention of issuing a Request for Proposals. On March 22, 1993, the Board held a prehearing conference in this matter, in which the Government chose not to oppose suspension of the procurement. On April 2, 1993, the Board received a joint motion to dismiss filed by both parties. The parties have stated that all disputes at issue have been settled and have requested that the Board dismiss the protest with prejudice. 2 Accordingly, the parties' joint motion to dismiss is granted. This protest is DISMISSED WITH PREJUDICE. The Board's order of March 23, 1993, suspending respondent's delegation of procurement authority, lapses by its own terms. VINCENT A. LaBELLA Board Judge
