ORDER On February 1, 1993, Price Waterhouse protested the award to a competitor of a contract for computerized clothing manufacturing by the respondent, Defense Logistics Agency. We convened a prehearing conference and set a schedule of pre-trial proceedings. As part of the schedule, we set dates for submission of respondent's motion to dismiss for untimely filing and protester's reply. Price Waterhouse had been eliminated from the competitive range some months before the filing of the protest, and had waited for a post-award debriefing before filing its protest. On February 8, instead of a motion to dismiss for untimely filing, the Board received a joint motion for voluntary dismissal of the protest without prejudice. Pursuant to Rule 28(a)(1), this protest is DISMISSED WITHOUT PREJUDICE, to be automatically converted into a dismissal with prejudice unless reinstated within ten working days of the date of this order. ________________________________ ANTHONY S.
