Order Protester, Computer Associates International (CAI) filed the instant protest with the Board on January 15, 1993. On January 21, 1993 protester filed a motion asking the Board to dismiss its protest without prejudice. The purpose of the dismissal was to allow the protester to intervene in a protest of the same procurement previously filed with the General Accounting Office (GAO). The respondent objects to this request, but has indicated it would not object to CAI dismissing with prejudice. The protester has agreed to a dismissal with prejudice to reinstatement at the Board, which addresses respondent's basic objections to the dismissal without prejudice. The dismissal will prevent CAI from refiling at this Board, but is not 2 considered a decision on the merits of the protest. Decision The protest is DISMISSED WITH PREJUDICE TO REINSTATEMENT AT THE BOARD.
