_______________________________________________ DISMISSED WITH PREJUDICE: January 15, 1993 _______________________________________________ GSBCA 12254-P JAMES W. COLLINS & ASSOCIATES, INC., Protester, v. DEPARTMENT OF THE NAVY, Respondent. James W. Collins, President of James W. Collins & Associates, Inc., appearing for Protester. Peter D. Butt, Jr., Katherine A. Andrias, and Geoffrey D. Chun, Office of the General Counsel, Naval Regional Contracting Center, Washington Navy Yard, and Demetria T. Carter, Office of Counsel, Naval Supply Systems Command, Department of the Navy, Washington, DC, counsel for Respondent. HENDLEY, Board Judge ORDER On January 8, 1993, the Board docketed a protest filed by James W. Collins & Associates, Inc. (JWC). JWC protested the award of contract number N00600-93-C-0437, under solicitation number N00600-92-R-2847, for automatic data processing equipment to another offeror by the respondent, the Department of the Navy. JWC alleged that its cost proposals were not properly evaluated, thereby resulting in it being unfairly eliminated as the possible lowest bidder. On January 13, 1993, the respondent telephoned the Board and stated that the parties had settled the protest. On January 14, the Board received the protester's request for dismissal, which states: We have settled our dispute with the Naval Regional Contracting Center and request the Board dismiss with prejudice at no cost to the Government. Accordingly, the protest is DISMISSED WITH PREJUDICE. Rule 28(a). ____________________________________ JAMES W. HENDLEY Board Judge
