ORDER On December 31, 1992, CBIS Federal Inc. (Cincinnati Bell), which was the prevailing party in a protest it brought, moved the Board for an order requiring the Department of the Interior (Interior), respondent, to pay protester's costs of filing and pursuing the case. See CBIS Federal Inc. v. Department of the Interior, GSBCA 12092-P, 1992 BPD 386 (Dec. 4, 1992). Cincinnati Bell asked the Board to award it the sum of $102,172.25. Interior responded by stating that it does not oppose the motion, but intends to pay protester the requested sum directly. The Government asked that we take no action on the motion while arrangements for the payments were being made. On April 15, 1993, Cincinnati Bell informed us that Interior has issued a purchase order to protester for the payment of all requested costs, and that once Cincinnati Bell submits an invoice to the Government, payment can be made. With Interior's concurrence, Cincinnati Bell asked that we dismiss the case without prejudice, the dismissal to become one with prejudice in forty-five days. This case is now DISMISSED WITHOUT PREJUDICE to its reinstatement within forty-five days from the date of this order.
