On October 13, 1992, Integrated Systems Group, Inc. filed this protest contending that the respondent, the Department of Transportation, Federal Aviation Administration, improperly proceeded under a Commerce Business Daily notice by failing to include protester in an open market procurement, thereby violating regulation, 41 CFR 201-39.803 (1992). During the initial conference, protester requested that its protest be dismissed with prejudice. The agency concurred with the request. Accordingly, the protest is DISMISSED WITH PREJUDICE.
