______________________________________________ DISMISSED WITH PREJUDICE: October 15, 1992 ________________________________________________ GSBCA 12108-P VALIX FEDERAL PARTNERSHIP I, Protester, v. DEPARTMENT OF THE AIR FORCE, Respondent. Shelton H. Skolnick, Derwood, MD, counsel for Protester. Gregory H. Petkoff, Office of the General Counsel, Department of the Air Force, Washington, DC, counsel for Respondent. HENDLEY, Board Judge. ORDER On October 13, 1992, the Board docketed a protest filed by Valix Federal Partnership I (Valix). On June 19, 1992, respondent, the Department of the Air Force, synopsized in the Commerce Business Daily (CBD), with an intent to place an order against the Zeos GSA Schedule, a requirement for automatic data processing equipment to be installed at Scott Air Force Base, Illinois. An award was made to Zeos under solicitation number F1623-92-R-0055. Valix was an unsuccessful offeror and alleged in its protest complaint that the respondent failed "to properly evaluate the Valix proposal in that such actions are in violation of applicable statute and regulation." We scheduled a prehearing telephone conference for October 15 to establish a plan for further proceedings before this Board. On October 14, the parties informed the Board that the protester would be withdrawing its protest and requesting dismissal. On October 15, the Board received the protester's motion to dismiss with prejudice, which states: Valix Federal Partnership I ("Protester") requests that this protest be dismissed with prejudice. The Department of the Air Force ("Respondent") is aware of, and has no objection to, this motion. Accordingly, the motion is granted, and the protest is DISMISSED WITH PREJUDICE.
