________________________________________________ DISMISSED WITH PREJUDICE: October 16, 1992 _________________________________________________ GSBCA 12076-P VALIX FEDERAL PARTNERSHIP I, Protester, v. DEPARTMENT OF THE NAVY, Respondent. Shelton H. Skolnick, Derwood, MD, counsel for Protester. Jonathan Kosarin, Naval Supply Systems Command, Arlington, VA, and Michael J. Cunningham, Jr., NRCC, Philadelphia, PA, counsel for Respondent. VERGILIO, Board Judge. ORDER OF DISMISSAL On October 5, 1992, Valix Federal Partnership I filed with the Board a post-award protest involving the respondent, the Department of the Navy. Protester alleges that it was unfairly excluded from the competitive range, the agency improperly evaluated its cost proposal, and, because major changes were made, the requirement should have been resolicited. This Board protest follows the denial of an agency protest. On October 15, 1992, protester filed with the Board a request to dismiss the protest with prejudice. The agency does not oppose the motion. Accordingly, this protest is DISMISSED WITH PREJUDICE. Rule 28(a). _____________________________ JOSEPH A. VERGILIO Board Judge
