DEPARTMENT OF THE TREASURY, Respondent. Shelton H. Skolnick, Derwood, MD, counsel for Protester. Donald M. Suica and Eileen Strong, Office of Chief Counsel, Internal Revenue Service, Washington, DC, and Elliot M. Carlin and Linda P. Azmon, Office of Regional Counsel, Internal Revenue Service, New York, NY, counsel for Respondent. VERGILIO, Board Judge. ORDER On October 7, 1992, Integrated Systems Group, Inc. filed with the Board a post-award protest involving the respondent, the Department of the Treasury. Protester alleges that the agency's placement of an order under a GSA non-mandatory schedule contract violates regulation, 41 CFR 201-39.803 (1992). In particular, protester contends that the agency failed both to properly evaluate responses and to utilize the lowest cost alternative. On November 3, 1992, protester filed a motion requesting a dismissal with prejudice. The agency does not oppose the motion. Accordingly, this protest is DISMISSED WITH PREJUDICE.
