It concerns the procurement of automatic data processing support services by the United States Customs Service. LCT contends that the certification of independent price determination provided by the apparent successful offeror is false and that any award would, therefore, be contrary to law and regulation. A&T Systems, Inc. (A&T), the apparent successful offeror, has intervened in this protest as an intervenor of right. On October 30, protester and respondent filed with the Board a stipulation in which they have agreed to the dismissal of this case with prejudice. Accordingly, pursuant to Rule 28(a), this protest is dismissed with prejudice. The Board's order of October 5 suspending respondent's delegation of procurement authority, as applicable to the procurement which is the subject of this protest, lapses by its own terms. ____________________ EDWIN B.
