______________________________________________ DISMISSED WITHOUT PREJUDICE: September 1, 1992 ______________________________________________ GSBCA 11984-P VMX, INC., Protester, v. DEPARTMENT OF DEFENSE, and DEPARTMENT OF TRANSPORTATION, Respondents. J. Randolph MacPherson of Thelen, Marrin, Johnson, & Bridges, Washington, DC, counsel for Protester. Jack Shearer, Defense Commercial Communications Office, Defense Information Systems Agency (DISA), Scott Air Force Base, IL, counsel for Respondent Department of Defense. John R. McCaw, Jr., Anthony L. Washington, and Christian F.P. Jordan, Office of Chief Counsel, Federal Aviation Administration, Washington, DC, appearing for Respondent Department of Transportation. BORWICK, Board Judge. On August 24, 1992, protester, VMX Incorporated, filed a protest at this Board against the Department of Defense and the Federal Aviation Administration. Respondents had stated their intent to add voice mail service to the VTS contract. Protester alleged that voice mail service should be separately procured as the service was outside the scope of the VTS contract. On August 28, the parties advised the Board that they had settled their dispute and moved for dismissal without prejudice. The settlement provides that the contracting officer has withdrawn her denial of protester's agency protest and will reconsider that protest. Another contracting officer's decision will be issued no later than September 16, 1992. The contracting officer has instructed the prime contractor on the VTS contract to suspend the current August 28 proposal due date for voice mail service until fifteen working days after issuance of another decision on the agency protest. Respondents and the prime contractor will take no further action to acquire voice mail under the VTS contract until at least ten working days after protester's receipt of the contracting officer's new decision on the agency protest. Pursuant to the request of the parties, and Rule 28(a)(1), this protest is DISMISSED WITHOUT PREJUDICE. ________________________________ ANTHONY S. BORWICK Board Judge
