_________________________________________ DISMISSED WITHOUT PREJUDICE: August 26, 1992 _________________________________________ GSBCA 11983-P EVERGREEN INFORMATION TECHNOLOGIES, INC., Protester, v. DEPARTMENT OF THE NAVY, Respondent. Thomas E. Chilcott of Odin, Feldman & Pittleman, Fairfax, VA, counsel for Protester. Michael Cunningham, Naval Regional Contracting Center, Department of the Navy, Philadelphia, PA, counsel for Respondent. DANIELS, Board Judge. ORDER OF DISMISSAL On August 21, 1992, Evergreen Information Technologies, Inc. (Evergreen) protested the terms of the Department of the Navy's solicitation for proposals to supply to the Defense Printing Service an Electronic Document Repository and Distribution System. Among the counts of protest, Evergreen alleged that the Navy had precluded full and open competition by failing to provide sufficient time for a response to the solicitation. On August 25, Evergreen filed a letter stating that it had been advised by counsel for the procuring agency that the submission date for offers has been extended indefinitely. Evergreen consequently withdrew its protest, seeking a dismissal without prejudice to reinstatement. We have determined by telephone that respondent has no objection to this request. The protest is DISMISSED WITHOUT PREJUDICE. Rule 28(a). _____________________________ STEPHEN M. DANIELS Board Judge
