ORDER This protest was filed with the Board on July 29, 1992, by LMTS Corporation (LMTS). Protester contends that a contract for a digital dynamic test control and analysis system was improperly awarded by the National Aeronautics and Space Administration (NASA). Specifically, protester alleges that the offer accepted by NASA was not in compliance with certain provisions of the solicitation. On August 3, protester advised the Board that it was withdrawing the protest and that counsel for respondent had no objection to its doing so. Accordingly, pursuant to Rule 28(a), this protest is DISMISSED WITHOUT PREJUDICE. The dismissal shall deemed to be with prejudice five days from the date of this order unless a party moves for reinstatement of this protest prior to the expiration of that period. The Board's order of July 31 suspending respondent's delegation of procurement authority, as applicable to the procurement which is the subject of this protest, lapses by its own terms. ____________________ EDWIN B.
