DISMISSED WITH PREJUDICE: August 26, 1992 GSBCA 11934-C(11883-P) ELECTRONIC SYSTEMS & ASSOCIATES, INC., Protester, v. DEPARTMENT OF THE AIR FORCE, Respondent. Lemuel Kinney, President and CEO, Electronic Systems & Associates, Inc., St. Petersburg, FL, appearing for Protester. Joseph M. Goldstein, Office of General Counsel, Department of the Air Force, Washington, DC, counsel for Respondent. DANIELS, Board Judge. ORDER OF DISMISSAL On July 21, 1992, Electronic Systems & Associates, Inc. filed a motion for reimbursement of costs incurred in the successful pursuit of a protest against the conduct of a procurement by the Department of the Air Force. See Electronic Systems & Associates, Inc. v. Department of the Air Force, GSBCA 11883-P, 1992 BPD 187 (July 15, 1992). The amount sought was $14,462 -- $14,282 in salaries of protester's personnel and $180 in telephone, facsimile transmission, and courier costs. In response, the Air Force noted that as decided in Sterling Federal Systems, Inc. v. National Aeronautics & Space Administration, GSBCA 10000-C(9835-P), 1992 BPD 141 (May 22, 1992) (full Board), in-house personnel costs incurred in pursuing a protest may not be awarded by the Board. On August 26, protester acknowledged the application of this decision and asked that the cost motion be dismissed with prejudice. This case is now DISMISSED WITH PREJUDICE.
