ORDER Appellant, Unique Janitorial Service, Inc., was awarded a contract by respondent, the General Services Administration, to perform janitorial services on a federal building in Marfa, Texas. Appellant submitted a claim to the contracting officer for additional work which was provided for under the terms of the contract, and which the Government had requested be performed. In its claim, appellant also requested reimbursement for travel expenses for travel from its offices in El Paso, Texas, to Marfa, Texas, which is three to three-and-one-half hours away. Appellant's claim was returned unpaid citing that travel time and mileage are not reimburseable expenses. On July 26, 1995, appellant sent a certified letter to the contracting officer requesting a final decision within sixty days. No decision has yet been issued. It is from the deemed denial that appellant filed this appeal on October 31, 1995. On November 2, the Board suspended the normal proceedings for appeals and directed the contracting officer to issue a final decision by December 4, 1995. On December 12, the parties filed a stipulation for dismissal with prejudice which states, in part: The parties have resolved the issues in dispute between them. . . . This settlement is in full settlement and satisfaction of all claims costs or issues claimed by appellant, as of the present date, the parties have reached a settlement of all issues . . . . The parties hereby stipulate and agree that the Board is requested to enter an Order Dismissing with Prejudice the Appeal of Unique Janitorial Service, Inc. Accordingly, this appeal is DISMISSED.
