                                 ORDER
 
        Appellant,  Horizon  Tool,  Inc.,   appealed  a  contracting
   officer's decision  dated July  5, 1995, terminating  appellant's
   contract  for default.    In  a letter  dated  January 24,  1996,
   appellant advised the Board that on January 17, 1996, the parties
   entered into a settlement agreement.  Pursuant to  that agreement
   appellant  has moved to have its appeal dismissed with prejudice.
 
 
        Accordingly,  this appeal is DISMISSED WITH PREJUDICE.  Rule
   28(a).
