ORDER The lessor, under a contract with the General Services Administration to provide a facility for the Bankruptcy Court in San Francisco, California, claimed $140,880.08 in interest on lump-sum payments for building out the space. The contracting officer denied the claim, and the lessor appealed. On March 15, 1996, the parties filed a joint settlement agreement. The agreement states that the Government shall pay Joan C. Woodard, Receiver, as Successor-In-Interest to Bramalea Pacific, Inc., the amount of $37,500, inclusive of interest and costs under the Equal Access to Justice Act, 5 U.S.C. 504, within thirty days of March 14, 1996. The parties jointly requested that the appeal be dismissed, subject to reinstatement only if the terms of the settlement agreement are not consummated. The appeal is DISMISSED WITHOUT PREJUDICE. This dismissal shall become one with prejudice upon consummation of the terms of the settlement agreement or on April 30, 1996, whichever occurs earlier. _________________________ STEPHEN M.
